Introduction
"Program for measuring employee satisfaction" is software (Software as a service or SaaS) available at https://pulser.si/ and https://upitnik.hr, owned by Alma Career d.o.o. (hereinafter: AC), registration number: 5443709000, Dunajska cesta 159, 1000 Ljubljana, represented by director Tomaž Berkopec.
The goal is to enable companies (hereinafter: Participants) to use software for evaluating employee satisfaction and at the same time raise public awareness of the importance of the HR function in companies. By carrying out the research, it is also determined which are the best entities for work in the Republic of Slovenia, based on the experience and perception of the employees of these business entities.
Annual "Best Employer" Award
Business entities of all sizes, depending on the number of employees, can participate in the survey. Only business entities with 20 or more employees who conduct a survey among all employees in the company by November 30 of the current year can be included in the list for the "Best Employer" award. Research completed after November 30th will be considered as candidates for the following year's award. Participants are not obliged to apply for the award. Participants have the option of conducting several surveys during the year, but the first survey conducted in the current year, namely the one conducted after November 30 of the previous year, is taken into account.
The prize will be awarded to three (3) Entrants in the Large Enterprise category, three (3) Entrants in the Medium Enterprise category, three (3) Entrants in the Small Enterprise category, one (1) Entrant in the "Best Newcomer" category and one (1) Entrant , which achieves the highest overall score in the "Best of the Best" category. Also, in industries where there are enough Registered Participants, the award "Best Employer in the Industry" is awarded. The Participant's name and logo will not be published if the Participant does not place among the top three (3) participants.
Privacy
The participant participates in the research voluntarily. For the purposes of providing services in the research process, the research participant will provide AC with specific information about himself that is not public and of a confidential and/or private nature.
AC will also provide certain materials and information about himself that are not public and are of a confidential and/or private nature for the purposes of providing services in the research process.
The term 'confidential information' means data, oral and/or written (stored on any medium), which is designated as such when the information is provided and is intended solely for the purposes of conducting the research process. The obligation to maintain confidential information from this article does not apply in cases where requests for their provision arise from valid regulations of the Republic of Croatia or come from authorized bodies.
AC reserves the right to use confidential information for the purposes of group data analysis, on the basis of which it will publish the best ranked participants.
With respect to the confidential information assigned to it, AC undertakes to limit access to confidential information only to persons whose official duties include the collection and analysis of such information for the above purposes, whether employed by AC or are external collaborators to whom the AC can entrust work if necessary.
Obligations of the Participant
The participant undertakes to:
ensure appropriate sampling according to the size of the company and departments in the company in accordance with the conditions specified on the website https://pulser.si/, if the company wants to participate in the competition for the 'Best Employer' award;
keep the received questionnaire and confidential information within the company (do not forward confidential information to other legal entities);
to ensure the same possibility of participation for all employees;
inform employees of the purpose of using their work e-mail addresses if the survey is conducted via online questionnaires;
distribute instructions and questionnaires to employees who will participate in the survey and provide and deliver them to the AC in case of conducting the survey with printed questionnaires;
enter information about employees at the level of the group participating in the survey: education, number of employees and their e-mail addresses; the number of employees is considered the number of employees at the start of the employee satisfaction survey, regardless of any subsequent changes;
entering additional questions (outside the framework of standard questions in the questionnaire) is optional, and the participant is fully responsible for entering and correctly setting the additional questions;
settle the invoice for carrying out the research within the legal deadline.
The participant undertakes to study and, if possible, accept the following advice:
AC advises that the survey does not include employees who have been employed for less than three months, regardless of the type of employment, during the survey;
AC advises that employees who are on sick leave or maternity leave for more than three months during the survey are not included in the survey.
Obligations of the AC
AC undertakes:
to carry out the research within the agreed deadline with the Participant;
send instructions to all employees if Participants enable valid employee email addresses;
display the results of the survey at https://pulser.si/ after the deadline for conducting the survey;
publish the list of the best-ranked Participants at https://pulser.si/ after the completion of the survey among all Participants in the current year;
to provide Participants with the comparative results of the research (joint comparison with other Participants) after the completion of the research among all Participants in the current year;
after the end of the survey or after the service has been performed, AC will issue an invoice. The employee satisfaction survey service includes:
- carrying out research via an online questionnaire, printed questionnaires or combined
- the possibility of adding an unlimited number of additional questions
- the ability to filter the basic report according to demographic data and additional questions
- basic report
- additional report
- comparative report.
The price of the employee satisfaction survey is based on the total number of employees in the Participating Company. The price is calculated on the official website: Calculator | Pulser;
7. options for obtaining additional discounts for the Participant are available on the page: Calculator | Pulser and will be taken into account when creating an account if the Participant meets the conditions;
8. one year after conducting the survey, AC will permanently delete the email addresses of employees entered by the Participant and used exclusively to inform about the survey and to receive notifications and reminders about conducting the survey online.
Irregularities
In case of identified irregularities by the AC during the process of conducting the research, the AC will notify the Participant in writing and the results of the research will not be taken into account when determining the best ranked Participants.
If for some reason the Participant wants to repeat the survey and at the same time participate in the competition for one or more "Best Employer" awards, this is possible only once, only at the Participant's request and written explanation. AC will send a new invoice for the survey to be carried out again.
AC has the right to remove certain completed questionnaires of the Participant from the research if it finds irregularities in them.
All legal relations between AC and the Participant, in addition to these Terms of Use, are subject to Slovenian substantive law, with the exception of provisions on resolving disputes related to laws.
AC and the Participants will try to resolve all potential disputes peacefully, but in the event of legal proceedings, the competent court in Ljubljana has exclusive jurisdiction
